Privacy and Policy

        1. User data security is a top priority

          Cossmic Bear respects the privacy of all users of the website or online store (hereinafter referred to as “the customer” or “the customers”). These privacy policies form the basis for the processing of personal data and provide information on the type of user data collected by customers through Freeways, how Freeways uses this data, and the rights customers have. Freeways complies with applicable data protection laws and processes personal data solely for the purposes for which the data was transmitted. These privacy policies are adjusted, supplemented, or amended from time to time. With each new call or visit to the website, the current version available at that time applies. Should there be any contradictions between this privacy statement and the otherwise applicable contractual or business conditions of Freeways, the provisions of this privacy statement shall prevail.

           

        2.  Type and purpose of collected data

          The term “personal data” in the sense of this privacy policy includes information that can be used to personally identify customers. Processing of personal data refers to any handling of personal data, such as collecting, using, storing, disclosing, transmitting, or deleting data. Cossmic Bear automatically collects personal data when the customer interacts with the website or uses the online shop. On the other hand, personal data are collected automatically or manually which a customer provides (e.g., by making contact, creating a user profile or customer account).

           

           

        3. Data that is automatically collected 

          When visiting the Cossmic Bear website, statistical visitor data is automatically collected about which parts of the web offering are visited by the customer. Each time a webpage is called up, the web server automatically stores a so-called server log file, which contains, for example, the name of the requested file, the customer’s IP address, date and time of access, the browser used, operating system, the amount of data transferred and the requesting provider (access data), and documents the access. In this context, the use of so-called cookies is sometimes necessary (see paragraph 4 below). This access data is evaluated exclusively for the purpose of ensuring trouble-free operation of the site and improving our offer.

      2. Cossmic Bear does not automatically collect personal customer data such as name, address, telephone number, or email address. However, personal data of customers are collected when a customer voluntarily provides this information in the context of placing an order or when contacting Cossmic Bear (e.g., via contact form or email). Fields marked as mandatory are identified as such since Cossmic Bear needs the data in these cases for contract processing or to handle the contact and cannot send the order or the contact request without their specification. The data collected can be seen from the respective input forms. If a customer decides to open a customer account, Cossmic Bear uses the personal data for the purpose of opening the account. The mandatory information requested during registration must be provided in full; otherwise, Cossmic Bear may reject the registration. The personal data collected will be used by Cossmic Bear solely for the purpose of using the online shop or the respective offer or service for which the customer has registered. Furthermore, Cossmic Bear may use the customer’s email address to inform them about important changes, such as in the range of offers, or technically necessary changes. After the complete processing of the contract or deletion of the customer account, the customer’s data will be restricted for further processing and deleted after the expiry of the retention periods under tax and commercial law, unless the customer has expressly consented to further use of the data or Cossmic Bear reserves the right to further use the data, which is legally allowed. The deletion of the customer account is possible at any time and can be done either by a message to the contact details specified below (see paragraph 9 below) or via a function provided in the customer account for this purpose.

      5. The legal basis for collecting and processing the customer’s personal data depends on the specific purpose of the data processing. The following are particularly applicable: • The protection of Cossmic Bear’s legitimate interests, provided the interests or fundamental rights and freedoms of the customer are not unduly impaired; • The conclusion or fulfillment of a contract; or • The customer’s consent at the time of collecting the personal data. The customer can revoke their consent at any time. For this purpose, the customer can send a corresponding message to the contact details described below. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

        6. Use of Cookies and Data Utilization

      7. Cookies To continually improve the web presence for customers, Cossmic Bear may use cookies. Cookies are small software information that is stored on the customer’s computer hard drive by web browsers (e.g., Google Chrome, Internet Explorer, or Mozilla Firefox) to facilitate the use of the website (e.g., language selection, shopping cart, etc.). Some of the cookies used by Cossmic Bear are deleted after the browser session ends, i.e., when the web browser is closed (so-called session cookies). Other cookies remain on the end device and enable Cossmic Bear to recognize the customer’s web browser on the next visit (so-called persistent cookies). The storage duration can be found in the overview in the cookie settings of the web browser. Most web browsers automatically accept such cookies, but the web browser can be configured not to accept or store cookies. However, disabling cookies may limit the functionality of the website. Details can be found in the operating instructions or the help function of the web browser.

      9. The anonymized data, which are recorded when accessing the Cossmic Bear website via cookies, can be used for web analysis purposes, to optimize the website, and to measure performance. Cossmic Bear may use third-party services, which may have their own privacy policies, over which Cossmic Bear has no influence. Cossmic Bear uses features of the following web analysis services: Google Analytics The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google evaluates the use of the website to compile reports on website activities and to provide other services related to website and internet usage to Cossmic Bear. The IP address transmitted by the customer’s web browser as part of Google Analytics is not merged with other Google data. The information generated by cookies about the use of the website is usually transferred to a Google server in the USA and stored there. Google adheres to the data protection provisions of the “Swiss-U.S. Privacy Shield” agreement and has registered with the US Department of Commerce for the “Swiss-U.S. Privacy Shield” (information on the Swiss-U.S. Privacy Shield can be found at https://www.privacyshield.gov/Swiss-US-Privacy-Shield-FAQs).

      11. Google Ads and Google Conversion Tracking The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. As part of Google Ads, Cossmic Bear uses so-called conversion tracking. When the customer clicks on an ad placed by Google, a cookie for conversion tracking is set. These cookies expire after no more than 30 days and are not used to personally identify the customer. If the customer visits the Cossmic Bear website and the cookie has not yet expired, Google and Cossmic Bear can recognize that the customer clicked on the ad and was redirected to this page. Cossmic Bear receives from Google the total number of users who clicked on the ad and were redirected to a website tagged with a conversion tracking tag. However, Cossmic Bear does not receive any information that can be used to personally identify customers.       12. Google Maps The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Cossmic Bear uses Google Maps for the visual representation of geographical information. When using Google Maps, Google may process and transmit data about the use of Maps features by visitors to the websites, which may include the IP address and location data among others. Cossmic Bear has no influence on this data processing. To the extent that information is transferred to and stored on Google servers in the USA, the American company Google LLC is certified under the “Swiss-U.S. Privacy Shield.” To disable the service of Google Maps and thus prevent the transmission of data to Google, a customer must deactivate the JavaScript function in their web browser.       14. 8.  Social Media Content 

      15. Cossmic Bear may use social media plugins from social networks such as Facebook, Instagram, or Twitter on its website. When a customer visits a webpage that contains such a plugin, their web browser establishes a direct connection with the servers of the respective social network. The content of the plugin is transmitted directly from the provider to the web browser and integrated into the webpage. Through the integration of the plugins, the providers are informed that the customer’s web browser has accessed the corresponding webpage of Cossmic Bear, even if the customer does not have a profile with the respective social network or is not currently logged in. This information (including the IP address) is transmitted from the customer’s web browser directly to a server of the respective provider (possibly in the USA) and stored there.
      16.  If the customer is logged into one of the services, the social network providers can directly associate the visit to the Cossmic Bear webpage with the customer’s profile on the respective social network. If the customer interacts with the plugins, for example, by clicking the “Like” or “Share” button, the corresponding information is also transmitted directly to a server of the provider and stored there. The information is also published on the social network and displayed to the customer’s contacts. These social network platforms have their own privacy policies, over which Cossmic Bear has no influence.       20. If customers wish that none of these plugins be loaded, it is recommended to log out from the respective social networks. Furthermore, various web browsers can be configured or supplemented with add-ons (e.g., Facebook Blocker) to prevent the loading of social media plugins.

If a customer wishes to subscribe to a newsletter offered by Cossmic Bear, Cossmic Bear requires an email address from the customer and other information that allows verifying that the customer is the owner of the provided email address and agrees to receive the newsletter (so-called “double-opt-in” procedure). If the customer, as a registered customer, wishes to sign up for a newsletter, they can give their consent during registration or later through the sign-up function in their customer account.
      24. With the newsletter, customers regularly receive recommendations and offers that may interest them. For this purpose, Cossmic Bear collects and processes personal data regarding the customer’s usage behavior on the website, orders from Cossmic Bear, and how the customer uses the newsletter (e.g., whether the newsletter is opened or which web URL links are clicked). Cossmic Bear may evaluate this data for statistical purposes to better tailor the content of the newsletters to the interests of the customers.

        The processing of personal data entered into the newsletter subscription form is based on the customer’s consent, which can be revoked at any time for the future. The revocation can be made either via the “Unsubscribe” link in the newsletter, a written notification from the customer to Cossmic Bear at the address listed below, or by logging out in the customer account. The collected personal data is used by Cossmic Bear for the content design and sending of the newsletters. There is no transfer to third parties for their own (advertising) purposes.

        Cossmic Bear stores the personal data provided by the customer for the purpose of subscribing to the newsletter until the customer unsubscribes from the newsletter.

         

        10. Disclosure of Your Data 

        Cossmic Bear will not disclose personal data of customers to third parties, except where the customer has consented to the disclosure of data to companies not affiliated with Cossmic Bear, or where Cossmic Bear is legally, administratively, or judicially obligated to do so. This also applies when service providers, who support Cossmic Bear in data processing, managing the website, or in any other manner, as well as in providing the products and services requested by Cossmic Bear, are engaged (e.g., parcel or newsletter dispatch service providers). These third parties are obligated to maintain the same level of security and data protection as Cossmic Bear.

         

        11. Data Security

        Unfortunately, the transmission of data over the Internet is not completely secure. Cossmic Bear works with service providers and Internet providers that implement appropriate technical and organizational security measures to protect the personal data of customers. However, Cossmic Bear cannot guarantee the security of data transmitted by customers. Therefore, any data transmission is at the customer’s own risk.

         

        12. Your Rights to Information and Revocation 

        Of course, every customer is free to inform Cossmic Bear at any time – for instance, in an email – that their personal data should not be used for contact purposes in the future. Participation in special services of the Cossmic Bear website, such as the newsletter service, can also be revoked at any time. Additionally, there is the possibility to obtain information about the processing of data or to request a copy of the personal data that have been collected via the Cossmic Bear website.

        14. Final Provisions
